1. General Agreement of Terms of Service
By accessing this website ("Site"), or any data or work therein, you agree to the term of this license agreement ("Agreement") with Quantum Shift, Inc., (referred to therein as "Quantum Shift Health & Wellness," "us", "our," "QuantumShift.Health", "Services," "Products," "Programs," "Program Materials"). Your ("You" or "Your") continued acceptance of, and compliance with, these terms of agreement are a condition precedent to your right to access or use this site, or any portions thereof.
If you do not agree with these Terms of Service, please do not enter this site or use our Services.
2. All Materials are Owned, Licensed, and Copyright of Quantum Shift, Inc.
You agree all Services, Products, Programs, and Program Materials are owned, licensed, copyrighted, and operated by Quantum Shift, Inc.
3. All Users Must Be 18 Years of Age or Older
All of our Services, Products, Programs, and Program Materials are intended solely for users who are eighteen (18) years of age or older. Any registration by, use of, or access to any Services, Products, Programs, and Program Materials by anyone under age 18 is unauthorized, unlicensed, and in violation of these Terms of Use.
4. Property, Ownership, Licensing of Services, Products, Programs, and Program Materials by Quantum Shift, Inc.
Our Services, Products, Programs, and Program Materials are the property of Quantum Shift, Inc., and/or our affiliates and licensees, and are protected by copyright, trademark, and other intellectual property laws. The content in our Services, Products, Programs, Program Materials, and Site is solely owned by or licensed to Quantum Shift, Inc unless otherwise indicated. This content includes, but is not limited to, the design, layout, look, appearance, graphics of our Site Products, Programs, Program Materials, or any other material or aspects of materials provided by us to you.
Reproduction of any Program, Product, Product Material, or Site or portion of the Site is prohibited. For the avoidance of doubt, all content obtained through QuantumShift.Health and its affiliated programs are the intellectual property of Quantum Shift, Inc. By purchasing or using any of our Services, Products, Programs, and Program Materials you agree to accept these Terms of Use as well as our Disclaimers, Terms of Use, and Privacy Policy, and any other terms and conditions that may apply. Use is limited to you and your use, only. You may not use our Services, Products, Programs, and Program Materials in a manner that constitutes an infringement of our intellectual property rights, copyright, or trademarks, or in a manner that has not been authorized by Quantum Shift, Inc.
5. Warranty Disclaimer
i. The Site, and any portions thereof, including links to third parties, are provided "as is" and without warranties of any kind. Quantum Shift, Inc. and its' employers, agents, contractors, subcontractors, contributors, and third-party providers ("Quantum Shift, Inc. Related Providers") do not warrant, guarantee, or make representations concerning the Services, Products, Programs, Program Materials, or the Site. Moreover, Quantum Shift, Inc. and its related third-party providers do not make any warranties, express or implied, including, without limitation, about the merchantablity, suitability, fitness for a particular purpose, accuracy, completeness, currentness, and/or non-infringement of any intellectual property rites with respect to the Site.
ii. You: (1) assume all risks as to the suitability, use, results of use, performance, accuracy, completeness, currentness, and performance of the site; (2) waive any claim of detrimental reliance on the Site; (3) waive any claim based on the accuracy, completeness, and currentness of the Site, to the maximum extent permitted by law.
6. Medical Disclaimer
i. Dr Teresa Ottewell is not a licensed conventional medical doctor and does not advise, diagnose, prescribe, claim to cure, or treat specific medical conditions. If you are under the care of a licensed medical practitioner it is strongly advised that you contact them for appropriate medical advice before purchasing any Sessions, Products, Programs, or Program Materials from QuantumShift.Health. Testimonials do not constitute a guarantee, warranty, or prediction regarding the outcome of an individual. Dr Teresa Ottewell accepts no legal liability or responsibility whatsoever for the use or misuse of the information contained on this Site.
Dr. Teresa Ottewell, PhD, & DNM is Board Certified by the American Alternative Medical Association #38284305 and the American Naturopathic Medical Certification Board #30204EHC.
ii. Quantum Shift, Inc Services, Products, Programs, and Program Materials and/or their content, and/or in any linked material, are presented for informational purposes only and are not a substitute for medical advice, diagnosis, treatment, or prescription.
iii. Never disregard medical advice or delay in seeking medical advice or attention. Dr Teresa Ottewell and Quantum Shift, Inc are absolved of any legal responsibility based on what has been perceived or implied in Quantum Shift, Inc Services, Products, Programs, Program Materials, and Site, and their content and/or in any linked material.
iv. Do not stop taking any medications without speaking to your licensed physician, nurse practitioner, physician assistant, mental health provider, or other healthcare professional. If you have or suspect that you have a medical or mental health issue, contact your own licensed health care provider promptly. Quantum Shift, Inc and Dr Teresa Ottewell do not provide licensed medical health care or licensed therapy services nor do they attempt to diagnose, treat, prescribe, cure, or claim to cure.
v. The United States Food and Drug Administration has not evaluated any statement, claim, or representation made in or accessible from our Services, Products, Programs, and Program Materials and their content, and/or in any linked material. The content of Quantum Shift, Inc Services, Products, Programs, and Program Materials and their content, and/or in any linked material, does not necessarily reflect the opinions of the principal author and is not guaranteed to be correct, complete, or up-to-date.
vi. Quantum Shift, Inc does not make any representation as to the physical, mental, emotional, or spiritual health benefits, future income, expenses, sales volume or potential profitability or loss of any kind that may be derived as a result of your participation in our Services, Products, Programs, Program Materials, and Site. Quantum Shift, Inc cannot and does not guarantee that you will attain a particular physical, positive, or financial result through the use of our Services, Products, Programs, Program Materials, and Site.
vii. Quantum Shift, Inc also expressly disclaims responsibility for the choices, actions, results, perceptions, understandings, misunderstandings, use, misuse, or non-use of the information provided or obtained through any of our Services, Products, Programs, Program Materials, and Site. You agree that your results are strictly your own and that Quantum Shift, Inc is not liable or responsible for your results.
7. Mandatory Completion of Intake Forms
All clients will receive a mandatory intake form that must be completed prior to the session. This intake form ensures that the work of Quantum Shift, Inc and Dr Teresa Ottewell aligns with your health priorities, goals, resources, and desired outcomes. During this intake process, it is mandatory to disclose if you are under the care of a licensed mental health service provider. See Item 18 for further detail.
8. Appointment Scheduling
i. All appointments are in Pacific Standard or Pacific Daylight Time. Your timezone will be calculated automatically when you schedule.
ii. At this time, all sessions are offered on a HIPAA-certified telemedicine platform. If you are not able to use telemedicine and prefer telephone, a photograph of you must be emailed to me in advance of your session.
iii. Due to practitioner availability and scheduling, at this time in-person sessions are not offered.
9. Payment Policy
i. Session Payment Policy: Credit card information must be submitted and full payment must be made for an appointment to be scheduled. All payments are USD.
ii. Services, Products, Programs, and Program Materials Payment Policy: Payment must be completed in advance of participation in services and programs, and prior to product distribution or program material distribution.
10. Cancellation Policy
I understand -- things happen! Life can be unpredictable and sometimes the universe has other things in mind. As such, our cancellation policy is quite flexible.
i. Cancellations can be made by you up to 24 hours in advance of the session and rescheduled by you at a later date through your private booking link.
ii. Appointments cancelled within 24 hours of your scheduled session are considered no-shows and full payment for the session will be processed.
iii. If you email, text, or leave a voicemail with me in the 24 hours before your appointment, I will consider your appointment cancelled.
It is best to connect directly with me at (805) 669 0883 if you are unable to keep your appointment within the 24 hour period and need to reschedule.
11. No-Show Policy
No-show appointments will be removed from the practice list and full payment for the missed session will be processed.
12. Rescheduling Policy
Appointments may be rescheduled up to 24 hours before the scheduled session through your booking link. Appointments rescheduled within 24 hours of the appointment are considered no-shows and no refund is given. It is best to connect directly with me at (805) 669 0883 if you are unable to keep your appointment within the 24 hour period and need to reschedule.
13. Late Policy
Please note that sessions are often scheduled with only a short buffer of time between sessions. For the consideration of all, if you do not show up for your session on time, we cannot extend your session beyond your scheduled time. To avoid technical delays, it is advisable to test the Telehealth platform link with a housemate or on your own before your session. If you have a technical issue and need to connect via phone for your session, this can easily be accommodated by texting me prior to your session at (805) 669-0883.
14. Refund Policy
i. Session Refunds: No refunds. Appointments may be rescheduled in accordance with Cancellation Policy (10) and Rescheduling Policy (12).
ii. Online/Digital Content, Training Programs, Group Sessions, or Products: No refunds are given for any online/digital content, training program, group session, or product. Issues with downloading digital content or accessing private member groups will be resolved with a technical support specialist. Contact us if you are having an issue accessing purchased materials.
15. Practitioner Cancellation
Occasionally situations can arise where we may need to reschedule your appointment (illness or family emergency). In the rare instance this may happen, you will be automatically rescheduled to the next available appointment.
16. Software, Internet Issues, or Hardware Failure
At times, software, internet, and computers can wreak havoc on Telemedicine sessions. In the event of a software, internet, or hardware issue during a session, we will continue the session by phone. Any last-minute rescheduling or same-day cancellation due to software, internet, or hardware failure on your end will result in a $100 cancellation and rescheduling fee.
17. Public Posting of Your Session or Content Material
All sessions are governed by HIPAA privacy and as such, you do not have permission to share or publish any portion of your session publicly. Recordings are for your personal use only.
You do not have permission to share, post, or publish any information, materials, or content from our workshops, group sessions, online training programs, or membership platforms. This includes screenshots, written material, graphics, or videos. All material is under copyright protection of Quantum Shift, Inc and Dr Teresa Ottewell.
18. Mandatory Disclosure of Previous Mental Health Diagnosis
If you are currently receiving or have ever received mental health care from a licensed healthcare professional, or have or once had a diagnosed mental health issue, or if you are currently taking, or have ever taken, psychiatric medication for mental health issues, you must inform us during your health consultation or health intake form. Failure to do so will result in your appointment being cancelled, full refund of your payment, and removal from our practice list.
19. Email and Text Reminders
Reminders for sessions and other essential communication will be automatically sent via email and/or text. Please verify that you have entered a working email address and an accurate cell phone number. Quantum Shift Health & Wellness and Dr. Teresa Ottewell cannot be held responsible for missed sessions due to typos or inaccuracies in your email address or cell phone number. Please double check your email and phone number.
20. Membership Cancellation Policy (when applicable)
Monthly memberships can be cancelled at any time. No refunds are given for Annual Memberships that cancel before the annual renewal date.
21. Modification of Site, Services, Products, or Programs
Quantum Shift Health & Wellness may change, discontinue, or suspend any Service, Product, Program, Program Material, or aspect of the Site, including the availability of any Site feature, database, link, or content. Quantum Shift Health & Wellness and Dr. Teresa Ottewell may also impose limits on certain features or services, or restrict or suspend access to parts of the Site without notice or liability at any time based on Quantum Shift Health & Wellness and Dr. Teresa Ottewell's exclusive discretion, without prejudice to any legal or equitable remedies available to Dr. Teresa Ottewell and Quantum Shift Health & Wellness for any reason or purpose.
22. Parody Social Media Accounts and Phishing Sites
Quantum Shift Health & Wellness and Dr Teresa Ottewell NEVER solicit payment or provide special exclusive offers for Services, Products, Programs, and Program Materials through direct or private messaging on your private, personal, or business social media accounts. If you receive a personal or private message through your social media account from accounts claiming to be Dr. Teresa Ottewell, Quantum Shift Health & Wellness, or QuantumShift.Health, immediately block and report these accounts as they are fraudulent. We are not responsible for any personal or financial losses from any Quantum Shift Health & Wellness or Dr. Teresa Ottewell parody account.
23. Privacy Policy
Quantum Shift, Inc and Dr. Teresa Ottewell are firmly committed to your privacy and do not gather or disseminate your personal information to third-party sites.
